Legal professional privilege plays a fundamental role in ensuring a fair and just legal system.
Client-lawyer confidential privilege must be maintained and not subject to coercion by anyone including enforcement agencies like the MACC.
The Malaysian Bar's reminder to enforcement agencies like MACC is therefore a timely reminder not to subvert legal professional privilege.
Enforcement agencies should not be gung ho going after client-lawyer confidentiality in the so-called name of fighting corruption.
If there are any element of corruption by all means investigate but this should not involve nor threaten breaching legal professional privilege.
As it is, rights group LFL (Lawyers for Liberty) has slammed MACC denying harassment of lawyers
In doing what MACC is alleged to have done, the question may be asked if it has abused its power and therefore can, and ought to be sued?
Malaysians want our enforcement agencies to do their work without fear or favour but not exceed, and certainly not to abuse their power.
