Is Hotshot Lawyer Shafee Innocent Of Money Laundering Charges Against Him?

Najib's hotshot lawyer Shafee Abdullah has been charged for money laundering on two counts and a further two counts on violating the Income Tax Act.

Some say that that has come late in the day. But apparently netizens are happy that it has finally happened.

Shafee said he is innocent and that he is a victim of political persecution.

He said the charges against him were nonsense because the prosecution must show that he knew the monies he received were the proceeds from unlawful activities and they could not do that. After all, no one knew anything about the 1MDB scandal in 2013/2014.

But I don't think it is right to say that the prosecution must prove that the accused KNEW that the monies he received were from the proceeds of money laundering activities.

It is enough if it may be inferred from ANY OBJECTIVE FACTUAL CIRCUMSTANCES, even if the accused didn't know, but had reason to believe or had reasonable suspicion that the monies he received were the proceeds of unlawful activities.

OR, the accused without reasonable excuse failed to so ascertain.

Section 4(2)(a)(b) of the Anti Money Laundering Act Act 613

(All paraphrase and emphasis mine)

That is a lot of leeway for the prosecution to nail an offender.

And was it right to say nobody knew about the 1MDB scandal in 2013 or 2014 for by March 2013, if the date is right, the 1MDB scandal had already been first written in KiniBiz?

Well, Bolehland will have to wait and see.                       

But the fact that Najib's hotshot lawyer has finally been charged is news indeed.

For, for once, instead of being the hotshot lawyer defending his clients, he is now himself the man in the dock.
